No arrest can be made by an officer unless he witnesses a crime
to charge you with.
- Neither
you, your home or your car may be searched without your permission,
as a general rule.
- Upon being
arrested you must be read and/or explained your legal rights.
(You have the right to speak with an attorney.) (Your Miranda
Rights must be read to you only prior to an interrogation.)
- You have
the right to have any charge explained to you at the time of the
questioning and/or arrest.
- A search
warrant must be obtained prior to searching the property in your
control.
- If any property
is taken from you or from your property, you must be given a receipt
and the property must be properly stored and secured from damage
or theft.
- You are
entitled to call friends and family immediately after being arrested.
- You have
the right to call an attorney or doctor if needed immediately
after being arrested.
- You have
the right not to speak with or to a policeman prior to having
your attorney present.
- You have
the right to be released on a reasonable bond.
- You have
the right to be brought before a judge within a reasonable time
after arrest.
- You have
the right to confront witnesses against you.
- You have
the right to an attorney at every stage of your case.
