Documents needed by the law firm to prepare you bankruptcy
petition, schedules, statement of affairs:

  • The most recent bill, invoice, statement, demand letter, nasty-gram, or any other paper that you have received from your creditors. Your bankruptcy papers must correctly identify the name of your creditor, the address, the account number that identifies the debt, the amount owed, the date the debt was incurred and the consideration for the debt. Many times this information is contained on papers that are sent to you by your creditors.
  • Any document(s) that evidences your total gross income for the year in which you plan to file your case. This information is usually contained on recent pay stub(s).
  • Tax returns for the last three years (if you were required to file tax returns).
  • Inventory of all goods with fair market values. A fair market value is the price that a willing buyer will pay a willing seller in cash. Independent certified appraisers are available to do this for you if the goods are extensive and the debtor is unaware of the values. Include copies of any deeds, or title certificates for cars, boats, aircraft, or any other device where ownership is evidenced by a certificate of title.
  • List of ordinary and necessary expenses including but not limited to home mortgage or rent, utilities, maintenance, food, clothing, medical/dental, insurance, transportation, charitable contributions, recreation, child support or other care of a dependent, and so forth.
  • A list of any and all creditors to whom you will have paid more than $600 within 90 days of the filing of your petition.
  • Copies of any legal papers you have received in any and all lawsuits of any and all natures within one year of filing.
  • Any papers evidencing or relating to the transfer of any of your property within one year of filing your bankruptcy petition.
  • Any papers or documents evidencing or relating to the loss of any of your property within one year of the filing of your bankruptcy petition.
  • Current Drivers License and Social Security Card or any paper that evidences your social security number.

The above requested documents will contain much, if not all of the information that the attorney needs to prepare your petition, schedules and statement of affairs. Depending on the situation, other documents or information may be needed.
